Throughout this site, the terms “we”, “us”, “our”, and “operator” refer to Morgan Mode. Morgan Mode offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By accessing our website and/or purchasing something from us, you participate in our “Service” and agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”), including any additional terms referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.
Please read these Terms carefully before accessing or using our website. By using any part of the site, you agree to be bound by these Terms. If you do not agree, you may not use the website or access any services.
Any new features or tools added to the store are also subject to these Terms. The most recent version of the Terms is always available on this page. We reserve the right to update or change these Terms at any time by posting updates to our website. By continuing to use the website after changes are posted, you accept those changes.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.
By agreeing to these Terms, you confirm that you are at least the age of majority in your place of residence, or that you are the age of majority and have given us permission to allow your minor dependents to use the site.
You may not use our products for any unlawful purpose, nor may you violate any applicable laws in your jurisdiction.
You must not distribute viruses, worms, or destructive code.
Any breach of these Terms will result in an immediate termination of your access to the Services.
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (excluding payment information) may be transferred unencrypted over various networks and adapted to technical requirements. Payment information is always encrypted during transfer.
You agree not to duplicate, reproduce, sell or exploit any part of the Service without our express written permission.
Headings in this document are for convenience only and do not affect interpretation.
ARTICLE 1 – DEFINITIONS
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Consumer: the natural person not acting in the exercise of a business who enters into a distance contract with the entrepreneur.
Day: calendar day.
Duration contract: a contract relating to recurring delivery of products or services.
Durable medium: any tool that allows a consumer or trader to store information addressed personally to them.
Right of withdrawal: the consumer’s ability to cancel a distance contract within the cooling-off period.
Entrepreneur: the natural or legal person offering products or services at a distance.
Distance contract: an agreement whereby, up to and including conclusion, communication is carried out exclusively by distance means.
Means of distance communication: tools for concluding a contract without simultaneous physical presence.
General Terms and Conditions: the present terms of the entrepreneur.

ARTICLE 3 – APPLICABILITY
These Terms apply to every offer by the entrepreneur and every distance contract concluded between the entrepreneur and consumer.
Before a distance contract is concluded, the text of these Terms will be made available to the consumer. If this is not reasonably possible, the entrepreneur will explain how the Terms can be viewed and will send them free of charge at the consumer’s request.
If the contract is concluded electronically, the Terms may be provided electronically in a manner that allows the consumer to store them on a durable medium.
If specific product or service conditions apply, they apply in addition to these Terms. In case of conflict, the consumer may rely on the provision most favourable to them.
If any provision is invalid, the remaining provisions remain valid, and the parties will replace the invalid clause with one that approximates its purpose as closely as possible.
Situations not covered by these Terms will be interpreted according to their intent.
ARTICLE 4 – THE OFFER
If an offer is subject to a validity period or condition, this will be clearly stated.
All offers are non-binding and may be modified.
The offer contains a clear description of the products or services offered. Images represent the products but slight variations may occur due to display settings. Obvious mistakes or errors do not bind the entrepreneur.
Each offer clearly states:
– the price;
– any shipping costs;
– how the contract is concluded;
– whether the right of withdrawal applies;
– the method of payment, delivery, and fulfillment;
– the period for accepting the offer;
– whether the agreement will be archived;
– how a consumer may correct submitted data;
– any languages available;
– applicable codes of conduct.
Optional product details such as size, colour, and materials may also be provided.
ARTICLE 5 – THE AGREEMENT
The agreement is concluded when the consumer accepts the offer and complies with its conditions.
If accepted electronically, the entrepreneur will promptly confirm receipt. Until the receipt is confirmed, the consumer may dissolve the agreement.
The entrepreneur takes appropriate technical measures to secure electronic data transfer.
The entrepreneur may verify whether the consumer can meet payment obligations. If justified, the entrepreneur may refuse an order or attach conditions.
Upon delivery, the entrepreneur provides:

the address for complaints;

conditions relating to withdrawal;

warranty information;

details from Article 4;
-
termination requirements for contracts longer than one year.
Every agreement is subject to availability.
ARTICLE 6 – RIGHT OF WITHDRAWAL
Consumers may cancel their purchase within 14 days after receiving the product.
During the cooling-off period, the consumer must handle the product carefully. If withdrawal is exercised, the consumer must return the product in original condition and packaging, where reasonably possible.
Consumers must notify withdrawal in writing or by email within 14 days of receipt. After notification, the consumer must return the product within 14 days.
If the consumer does not communicate withdrawal or fails to return the product in time, the purchase becomes definitive.
ARTICLE 7 – COSTS IN THE EVENT OF WITHDRAWAL
The consumer bears the return shipping costs, unless the product is defective or incorrect, in which case Morgan Mode bears the costs.
Refunds will be issued within 14 days after withdrawal, once the returned product is received or proof of return is provided.
Although the statutory withdrawal period is 14 days, Morgan Mode extends this to a 30-day return period from the delivery date.
ARTICLE 8 – EXCLUSION OF WITHDRAWAL
Withdrawal is excluded for products:

made according to consumer specifications;

clearly personal in nature;
-
which cannot be returned due to their nature;
-
liable to deteriorate;
-
whose price depends on financial market fluctuations;
-
newspapers or magazines;
-
audio/video/software with broken seal;
-
sealed hygiene items once opened.
ARTICLE 9 – PRICE
Prices may change due to VAT, import duties, or market fluctuations.
Import duties & taxes:
– UK: Delivered Duty Paid (DDP). VAT and duties included in the displayed price.
– EU: Prices include applicable VAT.
Typographical or pricing errors are not binding.
ARTICLE 10 – CONFORMITY & WARRANTY
Products must meet the contract, specifications, and legal requirements.
The entrepreneur’s warranty corresponds to the factory warranty.
Warranty does not apply if:
– the product is modified or repaired by the consumer;
– exposed to abnormal conditions or misuse;
– defects arise from regulations concerning materials.
Defective or incorrect products must be reported within 14 days.
ARTICLE 11 – DELIVERY & EXECUTION
Orders are shipped from our partner warehouse in Ningbo, Zhejiang, China through carriers such as Royal Mail, YunExpress, and 4PX.
Delivery times shown are estimates. Risk transfers to the consumer upon receipt.
Returns must be sent to:

The consumer bears return shipping costs unless the product is defective or incorrect.
Refunds are issued once the return is received and inspected.
ARTICLE 12 – DURATION CONTRACTS, TERMINATION & RENEWAL (FIXED & CLEAN VERSION)
Termination of contracts without a fixed term
The consumer may terminate an indefinite contract for recurring product delivery at any time with a notice period of no more than one month.
Termination of fixed-term contracts
A fixed-term contract may be terminated at the end of the agreed term, with a notice period of no more than one month.
Termination may be carried out:
– at any time once permitted by the contract,
– using the same method through which the contract was concluded,
– with a notice period not exceeding the entrepreneur’s own notice period.
Renewal
A fixed-term contract cannot be automatically renewed for another fixed term.
A contract may be renewed for an indefinite period only if the consumer may terminate at any time with a notice period of no more than one month.
Introductory subscriptions end automatically at the end of the trial period.
Duration
Contracts longer than one year may be terminated by the consumer after one year with a notice period of up to one month.
ARTICLE 13 – PAYMENT
Unless otherwise agreed, payments must be made within 7 working days after the start of the reflection period.
Consumers must promptly report inaccuracies in payment information.
If the consumer does not pay, the entrepreneur may charge reasonable collection costs.
ARTICLE 14 – COMPLAINTS PROCEDURE
Complaints must be clearly described and submitted within 7 days of discovering the defect.
Complaints will be answered within 30 days. If more time is needed, the consumer will be informed.
If the complaint cannot be resolved, it becomes a dispute subject to Article 15.
A complaint does not suspend obligations unless confirmed in writing.
If justified, the entrepreneur will repair or replace the product at no cost.
ARTICLE 15 – DISPUTES
These Terms are governed by the laws of the Netherlands.
If you reside in the United Kingdom, your mandatory UK consumer rights remain protected.
Disputes shall be submitted to the competent courts of the Netherlands unless UK law requires use of the consumer’s local court.

ARTICLE 15A – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Morgan Mode (Imexva B.V.) is not liable for indirect, incidental, or consequential damages. Liability is limited to the purchase price of the order in question.
Nothing in these Terms affects statutory consumer rights.
ARTICLE 16 – PERSONAL INFORMATION
Personal data submitted through the store is subject to our Privacy Policy.
ARTICLE 17 – ERRORS, INACCURACIES & OMISSIONS
Information may occasionally contain typographical or factual inaccuracies. We reserve the right to correct information or cancel orders if inaccuracies are discovered.
We are not obligated to update information unless required by law.
ARTICLE 18 – CHANGES TO THE TERMS
The latest version of these Terms is always available on this page.
By continuing to use the website after changes are posted, you agree to the revised Terms.
ARTICLE 19 – CESOP
Certain payment information may be recorded by payment service providers in accordance with the CESOP regulations introduced in 2024.
